Terms of Service

These Terms of Service ("Terms") govern your access to and use of YardHunts, including the YardHunts website, services, features, content, listings, accounts, and related products (collectively, the "Service").

By accessing or using YardHunts, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

1. Eligibility and Acceptance

You must be at least 18 years old to create an account, submit a listing, purchase a product or service, or otherwise use portions of YardHunts that require an account or transaction.

By creating an account, submitting content, purchasing a product or service, or otherwise using YardHunts, you represent that you have the legal capacity and authority to agree to these Terms.

If you use YardHunts on behalf of a business or organization, you represent that you are authorized to bind that organization to these Terms.

2. About YardHunts

YardHunts is an online discovery, directory, content, and listing platform designed to help people discover garage sales, yard sales, estate sales, thrift stores, antique shops, consignment shops, flea markets, secondhand businesses, and related shopping opportunities.

YardHunts may provide features including business listings, user-submitted sale listings, saved listings, notifications, community partner features, editorial content, shopping guides, digital products, affiliate recommendations, promotional opportunities, and other related services.

Unless expressly stated otherwise, YardHunts does not own, operate, manage, or control the independent businesses, sales, products, or services appearing on the platform.

The appearance of a business, sale, product, website, or other third party on YardHunts does not necessarily constitute an endorsement, sponsorship, partnership, or affiliation.

3. User Accounts

• You must provide accurate and complete information when creating or maintaining an account.
• You are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account.
• You may not impersonate another person or business, create an account using false or misleading information, or use another person's account without authorization.

YardHunts may suspend, restrict, disable, or terminate an account or access to the Service where permitted by applicable law, including in response to:

• violations of these Terms;
• fraudulent, deceptive, abusive, threatening, or unlawful activity;
• misuse or attempted misuse of YardHunts;
• security threats or suspected unauthorized access;
• infringement or alleged infringement of intellectual property or other rights;
• conduct that may harm YardHunts, its users, businesses listed on the platform, or third parties; or
• other circumstances in which restriction or termination is reasonably necessary to protect the Service, its users, or YardHunts.

YardHunts may investigate suspected violations and take reasonable action to protect the platform and its users.

4. Listings and User Submissions

Users may be permitted to submit garage sales, yard sales, estate sales, business information, photographs, descriptions, links, reviews, comments, or other content ("User Content").

You are responsible for User Content you submit.

You agree that information you submit will be accurate to the best of your knowledge and that you will not knowingly submit false, deceptive, fraudulent, defamatory, infringing, or unlawful content.

You may not create fake sales, impersonate businesses, misrepresent your relationship with a business, intentionally provide false locations or dates, or use YardHunts to promote unlawful activity.

YardHunts may review, edit, reject, remove, categorize, format, or moderate User Content when reasonably necessary to operate the Service, maintain quality, enforce these Terms, or comply with applicable law.

YardHunts does not guarantee that any submitted listing will be published, remain published, receive traffic, generate customers, or appear in search engines or AI services.

5. Business Directory Listings

YardHunts may create and maintain informational pages about businesses using publicly available information, information provided by businesses or users, licensed information, or other sources YardHunts is legally permitted to use.

Business listings may include information such as business names, addresses, telephone numbers, website links, social profiles, descriptions, categories, photographs, and other factual information.

YardHunts attempts to provide useful and accurate information but does not guarantee that every business listing is complete, current, or error-free.

Business owners or authorized representatives may contact YardHunts regarding inaccurate information or available options for updating, enhancing, or otherwise managing their listing.

Unless expressly stated otherwise, the presence of a business on YardHunts does not mean the business sponsors, endorses, or is affiliated with YardHunts.

6. Prohibited Conduct

You may not use YardHunts to:

• violate applicable laws or regulations;
• harass, threaten, abuse, stalk, intimidate, or harm another person;
• commit or facilitate fraud or deception;
• submit knowingly false or misleading information;
• impersonate another person, organization, or business;
• distribute malware or malicious code;
• interfere with the operation or security of YardHunts;
• attempt to gain unauthorized access to accounts, systems, databases, or networks;
• circumvent security or access controls;
• scrape, crawl, harvest, extract, copy, or systematically collect YardHunts content or user information through automated means without prior written permission, except to the extent such restriction is prohibited by applicable law;
• use YardHunts content or data to build or populate a competing directory, database, service, or commercial product without authorization;
• send spam or unauthorized commercial communications through the Service;
• misuse another person's personal information;
• upload content that infringes intellectual property, privacy, publicity, or other legal rights; or
• use YardHunts in a manner that materially disrupts or damages the Service or interferes with another person's use of it.

7. Ownership of YardHunts

YardHunts and its licensors retain all rights in the Service and in original content and materials created or owned by YardHunts, including, as applicable, the YardHunts name and branding, logos, website design, original written content, graphics, databases and compilations, software, features, and other proprietary materials, subject to applicable law and third-party rights.

Nothing in these Terms transfers ownership of YardHunts intellectual property to you.

You may not copy, reproduce, distribute, sell, license, modify, create unauthorized derivative works from, or commercially exploit YardHunts-owned content except with written permission or as otherwise permitted by law.

These Terms do not claim ownership of third-party trademarks, business names, photographs, content, or other intellectual property merely because they appear on YardHunts.

8. License to User Content

You retain any ownership rights you have in User Content you submit.

By submitting User Content to YardHunts, you grant YardHunts a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, adapt for technical or presentation purposes, distribute, and otherwise use that content as reasonably necessary to operate, promote, improve, and provide the Service.

This license allows YardHunts, for example, to display a photograph you upload with your sale listing, resize it for different devices, and display your listing throughout relevant areas of YardHunts.

You represent that you have the rights necessary to submit the content and grant this license.

9. Intellectual Property Complaints

YardHunts respects intellectual property rights.

If you believe content available through YardHunts infringes intellectual property rights you own or are authorized to enforce, contact legal@yardhunts.com.

Your notice should identify the protected work or right, the allegedly infringing material, where it appears on YardHunts, your contact information, and the basis for your claim.

YardHunts may remove or restrict access to disputed material when appropriate and may request additional information before acting on a complaint.

Nothing in this section constitutes an admission that challenged material is infringing.

10. Third-Party Websites and Services

YardHunts may contain links to third-party websites, businesses, social media pages, mapping services, payment services, products, or other resources.

YardHunts does not control those third parties and is not responsible for their availability, accuracy, security, products, services, policies, or practices.

Your interactions with third parties are between you and the applicable third party.

11. Affiliate Links and Advertising

Some YardHunts content may contain affiliate links or other compensated recommendations.

YardHunts may receive a commission or other compensation when users purchase products or take certain actions through those links.

Where required, YardHunts will provide appropriate disclosures regarding affiliate or sponsored relationships.

Compensation does not guarantee a particular review, ranking, recommendation, placement, or outcome unless expressly disclosed.

12. Community Partners, Featured Listings, and Promotions

YardHunts may offer businesses paid or complimentary promotional opportunities, including Community Partner status, featured placements, enhanced listings, sponsored content, or other promotional services.

Specific benefits, duration, pricing, renewal terms, and other conditions may be governed by the offer, order, agreement, or description presented when the service is purchased.

Purchasing promotional services does not guarantee website traffic, customers, revenue, search-engine rankings, AI visibility, leads, or any other specific business result unless YardHunts expressly agrees otherwise in writing.

YardHunts may identify sponsored or paid placements when required by law or appropriate for transparency.

13. Digital Products and Purchases

YardHunts may sell downloadable guides, toolkits, digital products, promotional services, or other products.

Prices and applicable purchase terms will be presented at or before checkout.

Unless otherwise stated at the time of purchase, digital products are licensed for the purchaser's personal or internal business use and may not be reproduced, resold, redistributed, published, or commercially exploited.

Refund policies, when applicable, will be disclosed at or before purchase or in a separate refund policy.

14. Garage Sales and Transactions

YardHunts provides tools to help users discover and promote sales but is not a party to transactions between buyers and sellers.

YardHunts does not inspect or guarantee items offered at garage sales, estate sales, businesses, or other locations.

Users are responsible for exercising appropriate judgment when visiting locations, purchasing items, meeting other people, or conducting transactions discovered through YardHunts.

YardHunts does not guarantee that a listed sale will occur as scheduled or that listed products will remain available.

15. Accuracy and Availability

YardHunts strives to provide useful information but cannot guarantee that all listings, business information, addresses, dates, hours, prices, descriptions, links, photographs, or other information will always be accurate, complete, or current.

The Service may occasionally be unavailable, interrupted, changed, or discontinued.

YardHunts may modify features, content, functionality, eligibility requirements, or portions of the Service from time to time.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YARDHUNTS AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

YARDHUNTS DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

YARDHUNTS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT INFORMATION AVAILABLE THROUGH THE SERVICE WILL ALWAYS BE ACCURATE OR CURRENT.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YARDHUNTS AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES DAMAGES ARISING FROM THIRD-PARTY BUSINESSES, SALES, TRANSACTIONS, USER CONTENT, LOSS OF DATA, LOSS OF PROFITS, OR RELIANCE ON INFORMATION AVAILABLE THROUGH YARDHUNTS.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless YardHunts and its owners, affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses, including reasonable attorneys' fees, arising from or related to:

• your violation of these Terms;
• User Content you submit;
• your violation of applicable law;
• your infringement or violation of another person's rights; or
• your misuse of the Service.

19. Suspension and Termination

YardHunts may suspend, restrict, or terminate access to the Service in accordance with these Terms and applicable law.

YardHunts may also remove listings or content when reasonably necessary to enforce these Terms, address legal or security concerns, protect users or third parties, or maintain the integrity of the Service.

Termination of an account does not automatically require YardHunts to remove information that YardHunts independently has a lawful right to publish, including independently maintained business-directory information.

Provisions that by their nature should survive termination, including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations, will survive.

20. Changes to These Terms

YardHunts may update these Terms from time to time.

When material changes are made, YardHunts will update the "Last Updated" date and provide additional notice when required by applicable law.

Your continued use of YardHunts after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

If you do not agree to revised Terms, you should stop using the Service.

21. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or the Service will be subject to the jurisdiction and venue of courts having jurisdiction in Oklahoma, except where applicable law provides otherwise.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

23. No Waiver

YardHunts' failure to enforce any provision of these Terms does not waive its right to enforce that provision later.

24. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular YardHunts product or service, constitute the agreement between you and YardHunts concerning your use of the Service.
